Disclaimer and limitation of use

  1. Accuracy of Predictions
Our predictions are based on computational fluid dynamics (CFD) simulations and high-resolution models of the turbulent atmospheric boundary layer, coupled with data from the characteristic curves of commercially available wind turbines. While we strive to ensure the highest accuracy through advanced modeling techniques and rigorous computational methods, all predictions are estimates and may vary from actual performance due to factors beyond our control, such as unexpected changes in weather patterns, mechanical performance variations, and other environmental conditions.
  2. Intended Use
The predictions provided are for informational purposes only. They are intended to assist in the planning and evaluation of wind energy projects but should not be used as the sole basis for financial, investment, or operational decisions.
  3. No Warranty or Guarantee
We make no warranties or guarantees, either express or implied, regarding the accuracy, completeness, or suitability of the predictions for any particular purpose. All data and predictions are provided “as is”, and we disclaim any liability for errors, omissions, or inaccuracies. The user assumes all risks related to the use of the predictions.
  4. External Factors
The actual performance of a wind turbine may be affected by factors that are not included in our simulation models, such as unmodeled microclimate variations, unanticipated maintenance issues, equipment wear and tear, or unexpected atmospheric events. These factors can cause discrepancies between predicted and actual outputs.
  5. Limitation of Liability
In no event shall we be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of or reliance on our predictions, even if advised of the possibility of such damages. This limitation of liability applies to all forms of claims, including but not limited to, loss of profits, loss of data, or business interruption.
  6. User Responsibility
It is the user’s responsibility to ensure that the predictions provided by us meet their specific needs and to use these predictions in compliance with all applicable laws and regulations. The user should consult with qualified professionals as necessary when making decisions based on the information provided.
  7. Revisions and Updates
Our models and predictions are based on the best available data at the time of analysis. We reserve the right to revise or update our models and predictions as new data, methods, or insights become available. Users should consider the date of issuance when evaluating the relevance and accuracy of the information provided.
  8. Intellectual Property
All models, simulations, and data are proprietary and protected by intellectual property laws. Unauthorized use, reproduction, or distribution of our proprietary content is prohibited.
  9. Governing Law and Jurisdiction
This disclaimer shall be governed by and construed in accordance with the laws of Belgium. Any disputes arising from this disclaimer shall be resolved in the courts of Belgium.
  10. Severability
If any provision of this disclaimer is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

By using our predictions, the user acknowledges acceptance of this disclaimer and agrees to the terms and conditions set forth herein.

This disclaimer aims to clarify the intended use, potential limitations, and risks associated with your predictions, and emphasizes the user’s responsibility in applying the provided data. It’s advisable to consult with legal professionals to ensure that the disclaimer meets your specific needs and any local or industry-specific legal requirements.
